1. TERMS OF DELIVERY
General shipping shall be 10 to 14 calendar days from receipt of payment. The delivery will be made through courier express, which will feature a number of follow-up and delivery with signature of the receiver. Where the customer wants to opt for a shipment certificate by a dedicated international transport service, an additional charge will apply to you, so you must previously please contact us. Once the shipping, we will provide a link to track your order online.
Shipping costs include the costs of handling and packaging of the product, as well as postal costs. Handling charges are fixed, while transport vary depending on the weight of the package. It is advisable to group items in the same order, since it is not possible to combine two different orders, which means that shipping charges will apply to each order.
VIRTUAL 360 FIT, S.L. company puts all media for the protection of sent items, and is not responsible for any damage that may occur in product once made the shipment.
The goods always travel by account and risk of the buyer, and the "FOB"/"FCA"/"CIF" of the Incoterms conditions in its definition of 2010.
VIRTUAL 360 FIT, S.L. can send invoices by regular mail to the address of the purchaser, or by e-mail, to the address the buyer communicate. The process does not provide for signatures or seals on printed invoices.
2. MANAGEMENT OF CONTAINERS AND PACKAGING
In accordance with current legislation, the liability for the management of commercial or industrial packagings corresponds to the last holder of the same.
Right of desisting: the law guarantees the right to desist from the contract, without having to prove any reason, during the 14 calendar days following the receipt of the product.
The return of the product must be in the same condition in which it was received and in the original packaging.
4. CLAIMS POLICY
In case of defective products buyer may make the claim according to the date of claim and the type of product. The product within the period of 14 days may be returned from the date of receipt, in accordance with the established in the previous paragraph, and in another case the legal warranty applies.
In the event that the buyer noticed a defect in the goods, you must do so expressly stated on the delivery note.
The existence of a claim, does not involve the suspension of the obligation of payment of the invoice.
5. PRICE AND PAYMENT
The goods sold by VIRTUAL 360 FIT, S.L. payment will be made within the period of thirty calendar days from the date of the invoice, unless otherwise agreed, that must be made in writing.
In the case of buyers whose credit is not registered, the payment will be made in cash, and can require VIRTUAL 360 FIT, S.L. a full or partial advance payment in cases where considered appropriate.
In case of postponements or instalments, the non-payment of any of the terms entitle VIRTUAL 360 FIT, S.L. to choose between declaring the early maturity of all debt and demand immediate payment, or recover the goods, being sufficient for this mere communication and without judicial intervention. Without limiting the foregoing, the delay in the payment of any of the terms will be the buyer, without request, interest on arrears corresponding to the current legal interest increased by four points. Also, they will be borne by the buyer return and processing costs. The existence of a claim of the purchaser in relation to the acquired material does not justify the delay or non-payment of a term.
The prices quoted in the tenders do not include the tax on the value added (VAT) or any other who could replace him, so it will impact separately in the invoice.
Our products have a guarantee of two years after the receipt of the same, except in the case of wires, clothing and other products whose useful life is less, so they have three months warranty, provided the equipment and spare parts have been properly used according to their conditions, features and specifications of use.
The warranty does not apply to faults or defects generated by, conservation and operation improper or wrong, or to derivatives of the amendments that have been introduced into the products without the express permission of VIRTUAL 360 FIT, S.L., nor when the installation has been made without following the instructions or are subsequently changed without their consent.
The warranty covers the repair of the products supplied, or if the replacement free of charge of the same.
To make use of the warranty, the customer must reach VIRTUAL 360 FIT, S.L. expenses, products or original parts damaged or defective. The costs of returning the product to the customer will be on their own.
Where once received the product by VIRTUAL 360 FIT, S.L. if the fault were result of a misuse of the same, not you can benefit of the warranty, return transport costs to be borne by the buyer.
In no case VIRTUAL 360 FIT, S.L. be held responsible for damages suffered by the buyer as a consequence of faults or defects in the products object of the guarantee, such as loss of production, benefits or costs of labor or capital among others, excepting fraud or neglect serious directly attributable to it.
7. APPLICABLE LAW AND JURISDICTION
For any dispute that may arise in the interpretation, enforcement or execution of the above conditions, Spanish legislation shall apply. The parties expressly submit to the courts and tribunals of Madrid capital, with express waiver of the jurisdiction to which they might be entitled to.
8. How to return a product?
- If you have a registered user account (username and password):
- Go to My Account section, you will find the link in the upper right area of the web.
- Select: historical and details of my orders
- Then click on Order Details
- Mark the checkbox of the product you want to return, as well as the number of products.
- o To conclude, write the reason for the return and press the button Request a return.
- If you do not have a registered user account:
- Go to the Contact page.
- Select the subject: Customer Service.
- Enter your email address.
Tell us in the message:
- Name and surname of the person who made the order.
- Email registered by the person who made the order.
- Order reference.
- Indicate the reason for the return, as well as the exact name of the item you want to return and the amount.
If the return is accepted we will contact you to indicate the product shipping details.
